Under the law, prior to property passing to the heirs and beneficiaries named in a Will, the Will itself must be submitted to the appropriate Probate Court for validation. Probate administration describes the process surrounding the settling of an estate through California’s Probate Court. This process contains detailed regulations on the manner and handling of an estate’s assets.
Probate administration begins when the executor files a will with the court. The will must first be validated. Then, the deceased person’s assets are collected. Debts are paid and the remaining assets are distributed to beneficiaries.
